India’s New Labour Codes: What Employees Should Know About Wages and Gratuity

India has rolled out four new labour codes aimed at simplifying workforce regulations and expanding social security. Key changes include revised definitions of wages, updated gratuity rules for fixed-term employees, and measures to extend benefits to gig and contract workers, reshaping the employment landscape across sectors.

From November 2025, India has implemented four consolidated labour codes, replacing multiple older laws with a streamlined framework designed to improve compliance and protect workers’ rights. The new rules aim to simplify wage structures, enhance social security, and make benefits more accessible to employees across industries.

One of the most notable changes affects gratuity eligibility for fixed-term employees. Under the new code, workers on contract become eligible for gratuity after just one year of continuous service, compared to the earlier requirement of five years. This move aligns contract workers more closely with permanent staff, ensuring that shorter-term employees receive financial recognition for their contributions.

The codes also redefine wages, standardizing components such as basic pay, dearness allowance, and retaining allowances. This clarity is intended to prevent disputes and ensure uniformity across sectors, including for minimum wage calculations and social security contributions.

Gig and platform workers are another focus area. For the first time, these workers are formally included in India’s social security framework, enabling access to benefits such as health insurance, provident fund contributions, and maternity support, bridging gaps in the unorganised sector.

While the reforms are welcomed by many as progressive, some industry bodies, particularly in the MSME sector, have raised concerns about compliance costs and the administrative burden of implementing new gratuity and social security provisions. Trade unions have also highlighted potential challenges in protecting workers’ bargaining power, emphasizing the need for careful enforcement.

Overall, India’s new labour codes represent a significant step toward modernizing workforce laws, balancing employee protection with employer responsibilities, and extending social security coverage to previously underserved groups.
